These Terms of Use (“Terms”) govern your access to and use of the Streamingo Sports Analytics service offered by Streamingo Inc. (“Streamingo,” “we,” “us,” or “our”) at sports-analytics.streamingo.ai (the “Service”). By accessing or using the Service, you agree to these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

1. The Service

The Service provides sports analytics capabilities, including tools to explore match-related data, visualizations, and related workflows. We may modify, suspend, or discontinue features with reasonable notice where practicable.

2. Accounts

You must provide accurate registration information and keep your credentials confidential. You are responsible for activity under your account. Notify us promptly of any unauthorized use.

3. Acceptable use

You agree not to:

  • Use the Service in violation of law or third-party rights;
  • Attempt to gain unauthorized access to systems, data, or accounts;
  • Interfere with or disrupt the Service or other users’ use of it;
  • Reverse engineer, scrape, or probe the Service except as permitted by law;
  • Upload malware or content that is unlawful, harassing, or infringes intellectual property.

4. Your data and content

You retain ownership of materials you submit to the Service. You grant Streamingo a license to use, host, process, and display such materials solely to provide and improve the Service for you and, where applicable, your organization. You represent that you have the rights needed to grant this license.

5. Intellectual property

The Service, including software, branding, and documentation, is owned by Streamingo or its licensors and is protected by intellectual property laws. Except for the limited rights expressly granted in these Terms, no rights are transferred to you.

6. Third-party services

The Service may integrate with or link to third-party services. Those services are governed by their own terms and privacy policies; we are not responsible for them.

7. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMINGO DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. ANALYTICS AND INSIGHTS ARE FOR INFORMATIONAL PURPOSES; YOU ARE RESPONSIBLE FOR HOW YOU USE THEM IN YOUR OPERATIONS OR DECISIONS.

8. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STREAMINGO AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR THE SERVICE IN THE TWELVE MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US$100), IF YOU HAVE NOT PAID US. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN THOSE CASES, THESE LIMITATIONS APPLY TO THE FULLEST EXTENT PERMITTED.

9. Indemnity

You will defend and indemnify Streamingo against claims arising from your use of the Service, your content, or your violation of these Terms, except to the extent caused by Streamingo’s willful misconduct.

10. Termination

We may suspend or terminate access to the Service for breach of these Terms or for other legitimate reasons, with notice where appropriate. You may stop using the Service at any time. Provisions that by their nature should survive will survive termination.

11. Governing law

These Terms are governed by the laws of the State of California, excluding its conflict-of-law rules. The state and federal courts located in Santa Clara County, California will have exclusive jurisdiction for disputes, subject to any rights you may have under mandatory local law.

12. Changes

We may update these Terms from time to time. We will post the revised Terms on this page and update the “Last updated” date. Continued use after changes become effective constitutes acceptance of the revised Terms, to the extent permitted by law.
